These Terms of Use ("Terms") govern your use of Day As Art (the "App"), provided to you by us ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, please don't use the App.
Day As Art is a journaling app for iOS. You write about your day, choose a mood and an art style, and the App generates an illustration based on what you wrote. Entries and images are stored on your device. Cloud sync, export, and social sharing beyond the system share sheet are not part of the current version of the App.
You may use the App as a guest, or create a local account with a name and email address. Account creation in this version of the App is local to your device — there is no server-side account system, and "logging in" on a different device will not restore your entries. You're responsible for whatever device and passcode security you use to protect access to the App.
The App offers an optional auto-renewing subscription ("Pro") that unlocks unlimited AI generations, higher-resolution illustrations, and additional art styles. Free accounts can create unlimited journal entries but are limited to a set number of AI-generated illustrations per calendar month.
You own what you write. By submitting a journal entry for illustration, you grant us a limited right to transmit that entry's text (along with your selected mood and art style) to our image-generation backend solely to generate the illustration you requested, as described in our Privacy Policy. We claim no ownership over your journal entries or the illustrations generated from them.
You agree not to submit content that is illegal, infringes someone else's rights, or that you don't have the right to submit.
Illustrations are generated by a third-party AI image model. AI-generated images can occasionally be inaccurate, unexpected, or not reflect exactly what you intended. We don't guarantee the quality, accuracy, or appropriateness of any generated image, and we reserve the right to adjust or replace the underlying generation service at any time.
Don't use the App to attempt to disrupt, reverse-engineer, or gain unauthorized access to our backend services, or to generate content that is unlawful, abusive, or violates the rights of others.
The App's design, code, and branding are our property or that of our licensors. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the App normally.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted, error-free operation.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including loss of data. Because journal entries and images are stored locally on your device, we strongly encourage you to keep your own device backups (e.g. via iCloud or a computer backup) — we cannot recover data lost due to device loss, damage, or an app/OS reinstall.
You may stop using the App and delete your account at any time from Settings. We may suspend or discontinue the App or any of its features at our discretion, though we'll try to give reasonable notice for any change that affects active subscribers.
We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the App after a change means you accept the updated Terms.
These Terms are governed by the laws of Spain, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Spain.
